Domestic Violence
In California in general, and in Los Angeles in particular, if your wife, girlfriend, or someone you are dating calls the police for domestic violence you will be arrested even if it is not true. That is the law.
Once the police arrive at your location do not speak to them. They are not your friends. Anything you say can and will be used against you. Your right to remain silent is your most important and valuable right. When the police ask question simply state you do not wish to answer any questions and you wish to contact your attorney.
The police may tell you that you will be arrested unless you talk, and that they may let you go if you talk. Do not believe them! You are going to be arrested! so remain silent and protect yourself.
If you explain that you are sorry and that you didn't mean it, they will consider that an admission and arrest you. If you say it was self defense, they will consider that an admission that you struck the other person and arrest you. If you say there was an argument and the accusation is false, they will consider it an admission that there was reason to strike the other person and they will arrest you.
Once you are arrested you will have to post bail (Bail). Once your bail is posted you will be released and you will be given a court date.
Your spouse, girlfriend, boyfriend, or date will not be able to have the charges dropped. The law is strict in California , a person reporting domestic violence may not under any circumstance drop charges. Only the prosecutor can bring a charge or drop a charge of domestic violence.
Your lawyer may be able to arrange an office hearing with the prosecutor's office. In this hearing both sides state their case and the hearing officer in conjunction with the prosecutor may decide to drop the case. Otherwise, the case will be sent on to court.
A case may be settled without a trial or it may go on to trial. Your lawyer may advise you to settle your case or go to trial, and provide you with details as to the consequences of each.
